Unlike many of our competitor’s; Max ID Protect provides a straight forward “Total Resolution Guarantee”. We do not advertise a flashy, misleading headline that promises one thing but the fine print reads something far different.
As a member of our services, you are protected and will have peace of mind if you become a victim of Identity Theft. A personalized Recovery Advocate will be just a phone call away to provide help and assistance from the moment the ID Theft is discovered until its resolution.
Max ID Protect will not reimburse special, incidental, indirect or consequential damages, such as lost wages or profits, loss of business, or lost opportunities.
Max ID Protect will cover expenses caused by Identity theft such as, investigators, lawyers, consultants, merchants, telephone communications with the credit bureaus and Id theft specialists, direct out-of-pocket expenses like postage, notary public fee’s, resolution and recovery firms and whatever else it takes to restore your good name to its pre-theft status..
Our Service Guarantee is in support of our Service under the Terms and Conditions Agreement and is provided without additional charge. In order to take advantage of our Service Guarantee, it is required that a police report be filed by the Max ID Protect member prior to making a claim.
Disputes under this Agreement shall be subject to Arbitration as stated in the Terms and Conditions.
You must be truthful with us at all times and you must tell us of any and all uses of your personal identifying information without your authorization to commit a fraud within five (5) days of you first learning of it. You also agree to cooperate with us and/or those we hire to help you, and with those members of law enforcement as needed.
When someone accesses your personal identifying information and subsequently uses it without your authorization to commit a fraud, due to a failure or defect in our Service, and you have complied with this Agreement, subject to the terms herein, we will pay professionals to assist in restoring any such loss or recover such expenses, as required.
We reserve the right to investigate any Service Guarantee request (claim) in order to determine whether the claim is valid before we do anything under the terms of this agreement. Such investigation will be performed swiftly without undue delay. If our investigation shows that a reasonable person would conclude that your personal identifying information was used without your authorization to commit a fraud while you were a client in good standing, and you have complied with this Agreement, we will perform as described herein.
If we find that you intentionally misrepresented damages or committed a fraud related crime and misrepresented that you were our client when your information was misused, you agree to pay us back upon demand any amount we have paid in connection with your claim, including any costs we incur to collect the money from you. Being found guilty of a crime related to the loss which you attributed to identity theft is sufficient evidence to conclude that we are entitled to recover all amounts paid on your behalf as described above, but it is not the only basis upon which we may so conclude.
If you need professional assistance to help remediate damages caused by the failure or defect in our Service, we will arrange for, and cover the expense of, that assistance to be provided to you through persons or firms we select; we will not reimburse fees of professionals or other service providers unless we choose those providers for your particular matter or agreed to do so in writing. Any such professionals, if required or applicable, will be licensed in the jurisdiction where your particular matter occurred.
Any and all suspected Identity theft committed prior to enrollment must be disclosed to Max ID Protect and is not covered under this Guarantee.
Other than this Service Guarantee and our Terms and Conditions, we make no representation or warranty about our services of any kind, and we disclaim any implied warranties outside of this Agreement, such as a warranty of merchantability or fitness of our service for any particular purpose.
